Government Contracts Partner Eric Crusius spoke with Government Matters about a recent Executive Order from President Joe Biden raising the minimum wage for federal contractor employees to $15/hour. Although the order will not be implemented until Jan. 30, 2022, agencies are encouraged to adopt the policy and raise wages before then. Mr. Crusius said he expects the services industry to be most affected, especially employees at call centers or in cleaning and maintenance jobs. He also advised contractors to save records to show the changes in wages for employees, as there may be an opportunity to work with agencies and receive a price adjustment for the difference. Beyond the executive order, Mr. Crusius briefly commented on the JEDI contract case, still in the litigation process after more than two years.

Senior Counsel Gina Fonte was interviewed by NPR Marketplace to discuss the responsibility of employers to keep track of sick workers as workplaces around the country reopen. Most states don’t require employers to report COVID-19 cases to local health departments, though large workplace clusters are often identified by those agencies. However, the federal Occupational Safety and Health Administration does require most companies with more than 10 employees to keep internal records of COVID-19 cases, but only when they’re confirmed and deemed “work-related.” And there’s an incentive for employers not to make those connections: Too many reported cases could trigger an investigation for unsafe working conditions.

\n“It’s a very difficult and onerous task to determine whether or not a COVID-19-positive case was work-related,” said Ms. Fonte. OSHA requires employers to make a “good faith effort” to determine how a worker contracted the virus, she said.

Immigration Partner Leon Fresco participated in a Bloomberg Law podcast discussion of immigration cases heard by the U.S. Supreme Court, including a ruling that bolstered states' power to prosecute undocumented immigrants. The central question in the case was whether a state was prosecuting an individual for lying on a tax form or on an I-9 form. In a 5-4 ruling, the court found that the prosecution was for lying on the tax form and was therefore justified. The dissenting opinion contended the opposite, stating that the individual provided inaccurate information for immigration-related purposes, which would make the state's prosecution invalid under Arizona v. United States. Mr. Fresco analyzes the decision and its implications.

\nThey offer a real-life example of this test in action; the California Supreme Court Dynamex Decision. This decision determined that the business does not need to control the exact details of the work in order to be found to have maintained the necessary control that an employer normally has of an employee. The hiring entity must establish that the worker is free of such control in order to establish ‘Part A’ of the ABC Test. They conclude by expressing the importance of companies being proactive and examining their delivery operations, marketing practices and their internal policies and procedures to ensure that they are consistent with independent contractor status.

On the PBS program \"Chicago Tonight,\" attorney Phillip Schreiber discusses an Illinois law that prohibits employers from asking applicants if they have been convicted of a felony on initial job applications. The law, known as \"Ban the Box,\" goes into effect Jan. 1, 2015.

“Essentially it delays when a perspective employer can inquire about a candidate's criminal history, until employer has notified the employee that the employee will be granted an initial interview,” Mr. Schreiber said.
