\nThey offer a real-life example of this test in action; the California Supreme Court Dynamex Decision. This decision determined that the business does not need to control the exact details of the work in order to be found to have maintained the necessary control that an employer normally has of an employee. The hiring entity must establish that the worker is free of such control in order to establish ‘Part A’ of the ABC Test. They conclude by expressing the importance of companies being proactive and examining their delivery operations, marketing practices and their internal policies and procedures to ensure that they are consistent with independent contractor status.

At CAPA's 2018 Americas Aviation Summit in Houston, Aviation attorney Anita Mosner moderated panel on rethinking United States foreign ownership rules for domestic airlines.

The U.S. applies one of the most restrictive regimes for foreign ownership of airlines of any developed country. While there is a great deal of rhetoric surrounding the reasons for this, there has not been a great deal of empirical evidence that it is in the national interest – or even that of the incumbent domestic airlines themselves. One argument sometimes raised is that in times of strategic emergency a largely foreign owned airline might not be available for national uplift. The panel addressed these concerns and compared foreign ownership rules of the U.S. with other countries, discussed the benefits of higher limits in the market and considered the advantages and disadvantages of more relaxed rules.

Drone Practice Team member Joel Roberson discusses the new hands-on drone testing program for members of the media and the potential implications of proceeding with the use of small unmanned aircraft systems (UAS) for news gathering purposes.

These flight tests are the first in a series of controlled testing of real-life scenarios to simulate news events that the media can safely report on using small UAS technology. The news media coalition's research and testing occurs in partnership with Virginia Tech, one of the Federal Aviation Administration's designated test sites for drone research. Following these initial test, a report will be presented to the FAA establishing appropriate safety procedures to support Section 333 applications and inform the final UAS rulemaking to ensure reporters and photographers can operate UAS for news gathering.

The NDAA created a new cyber breach reporting requirement affecting Department of Defense (DoD) contractors supporting transportation and logistics in connection with contingency operations, now known as \"operationally critical contractors.\" An operationally critical contractor is defined as a \"critical source of supply for airlift, sealift, intermodal transportation services, or logistical support that is essential to the mobilization, deployment, or sustainment of the Armed Forces in a contingency operation.\" This new class of contractors will therefore include companies, such as commercial airlines or rail or motor carriers, that transport DoD personnel, equipment or supplies, including fuel.

Ms. Bosco reviews this new criteria and offers guidance to help federal contractors comply with the new law.
